REFUND POLICY
If you choose to use our services, you must comply with our terms and conditions, privacy policy, and refund policy.
Where as the "customer", "buyer" or "you" refers to any entity or person who avails our services or purchases any of our products. "Spotverge" or "Company" refers to Spotverge, party signing the agreement, and providing the services to the customer. "Deliverables" refer to entities delivered by the company to the customer. Rights refer to the rights and privileges granted to the customer by the company.
Following is the refund policy for the services provided by Spotverge.
- Refunds for any product or services will be applicable as long as the customer abides by the terms and conditions, privacy policy, and refund policy.
- The customer will not qualify for a full refund if the tasks associated with the services have already commenced. The customer must also cancel the tasks within 3 working days of payment before requesting a refund.
- If the products provided by the company are "customized" or "changed" as per the customer's request, the products will be regarded or considered as "services", and the customer wouldn't be eligible for full refunds.
- If the The company is unable to fulfill the services or provide the products as documented in the agreement, the customer will be eligible for partial refund as long as the customer agrees with the terms and conditions, privacy policy and refund policy.
- The partial refunds shall not be applicable as long as the company agrees to fulfill the tasks provided by the customer and listed in the documented agreement.
- The partial refunds shall not be applicable if the company agrees with additional requests provided by the customer apart from the agreement.
- The customer would not qualify for a refund if they attempt to threaten, harass, or coerce the personnel, partners, or consultants of Spotverge.
- The customer would not qualify for a refund if they disclose the company's confidential information to third parties, except to law organizations, government organizations, and courts, as mandated by the law.
- Changes in organizational structure, project timing, personnel or staff, policies, and locations would not be the valid reasons to qualify for refunds, as long as the company agrees to fulfill the tasks listed in the documented agreement.
- If the project is postponed or cancelled by the customer, or if the customer fails to provide the necessary information, the company will not be liable for any losses or damages that the customer may incur.
- If the project is postponed or cancelled due to the intervention or delays by third parties, or any external/natural consequences, causes or damages, the company will not be liable for any losses or damages that the customer may incur.
- If the company cancels or postpones the services, or revokes the deliverables due to the uncertainty of customer's requirements, disputes initiated by the customer, or the customer's attempt to disrupt the company's services, the company will not be liable for any losses or damages that the customer may incur.
- The refund policy shall remain and act under the laws of Indian constitution. Should any clause of the contract be found to be illegal, unenforceable, or invalid, the rest of the contract will remain valid.
- Spotverge does not guarantee the continuity and reliability of service or refunds from the third parties including technical stack used, hosting and domain providers.
- The product/service may be suspended and the rights provided to the customer will be revoked in case of intentional chargeback/dispute received over the payment. The dispute must be resolved by the customer or the amount equivalent to the outstanding balance accrued as a result of chargeback plus chargeback fee and/or damages must be fulfilled by the customer in order to restore the services.
- The company has right to revoke the deliverables, cancel the services, transfer/revoke the rights provided, and suspend the account after the partial or full refunds are processed. The customer must agree with the refund agreement provided by the company after cancellation in order to avail refunds as agreed.
